License to User Content

When you upload User Content to our Services, you grant FightGen a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly display, and distribute such User Content for the limited purpose of operating, promoting, and improving our Services.

Generated Content

The images generated through our Services ("Generated Content") are owned by you, provided that you owned or had proper permission to use the original User Content. However, we reserve the right to use Generated Content for marketing, improvement of our Services, and training our AI models, unless you explicitly opt out.

4. Prohibited Uses

You agree not to use the Services to:

Violate any applicable law or regulation
Infringe the intellectual property rights of others
Generate, upload, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
Interfere with or disrupt the Services or servers or networks connected to the Services
Attempt to gain unauthorized access to any portion of the Services
Use the Services to generate deepfakes or other misleading content without proper disclosure

5. Subscription and Payments

We offer both free and paid subscription plans. By subscribing to a paid plan, you agree to pay the subscription fees as described at the time of purchase. All payments are non-refundable except as required by law or as explicitly stated in our refund policy.

We may change the fees for our Services at any time. If we increase fees for your current subscription plan, we will provide notice at least 30 days before the change takes effect.

6. Termination

We may suspend or terminate your access to the Services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Services, our business, or third parties, or for any other reason.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL FightGen BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE USE OF THE SERVICES.

9. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to its conflict of laws principles.
